“The attack was not intentionally but planned”

Seven months ago, Nurcan Kaplan, who applied for protective order 12 times against her husband, and her mother Nezire Demir were attacked by her husband, Tarık Kaplan, with a gun. Lawyer Zelal Erdemci told us that an indictment has been prepared against the perpetrator, who went to kill two women, for “deliberately” killing and injuring women not for “by planning”.

Amed – On June 1, 2021, Nurcan Kaplan and her mother Nezire Demir were attacked by Nurcan Kaplan’s husband, Tarık Kaplan, with a gun in the Şehitlik neighborhood of Yenişehir district, Amed. Nurcan Kaplan and Nezire Demir were seriously injured. Before the attack, Nurcan Kaplan filed a divorce lawsuit against Tarık Kaplan due to violence she faced. After the attack, Tarık Kaplan was detained and sent to prison. The Diyarbakır Chief Prosecutor's Office has prepared an indictment within the scope of the investigation launched into the incident. In the indictment, the prosecutor has demanded prison sentence against Tarık Kaplan on charges of “intentionally injuring” Nezire Demir, who was seriously injured by two bullets and on charges of “attempting to kill his wife”. Lawyer Zelal Erdemci reacted to the indictment and said, “The attack was not intentionally but planned.”

She applied to court for protective order 12 times

Stating that Nurcan Kaplan was subjected to systematic violence by her husband during her 16-year marriage and that she applied to court for protective order 12 times during her marriage, lawyer Zelal Erdemci emphasized that she wasn’t protected despite her applications.

“According to the prosecution, the accused acted ‘mercifully’”

Speaking about the incident, Zelal Erdemci said, “He opened fire on Nezire Demir and attempted to kill her. Although everything about the incident is obvious, the prosecutor demands prison sentence in the indictment against the perpetrator on charges of intentionally injuring Nezire Demir. In the indictment, it is stated that the accused had the opportunity to kill Nezire Demir, but he did not kill Nezire Demir despite this. The prosecution thinks that the defendant was very merciful.”

“He planned to kill them”

Emphasizing that Tarık Kaplan planned to kill Nezire Demir and Nurcan Kaplan, Zelal Erdemci said, “The attack was not intentionally but planned. Nurcan received treatment for her injuries for a long time and she hasn't completely recovered yet. In the indictment, her health problems haven’t been mentioned. The perpetrator should be punished for planning to kill two women to prevent violence.”

First hearing will be held on March 23

The first hearing of the trial will be held on March 23 by the Diyarbakır 13th High Criminal Court.
